Given the history of the relationship between Russia and CEE states and Russia's lagging emergence from its doctrinal and practical lacuna of nonsocialist international law, it is unlikely Russia will participate within a regime of transboundary environmental protection and respond to attempts by the CEE states to use international law or the legal process to resolve its potential outstanding liability unless CEE states create an incentive for Russia to participate within such a regime. The most likely means for creating such an incentive would lie with CEE states, in particular Poland, Slovakia and the Czech Republic, threatening to restrict oil and gas transshipment from Russia to Western Europe or for them to attach a transit tax for the purpose of creating an environmental remediation fund.
